COMPLIANCE · Starter PLAYBOOK
WHY THIS CATEGORY IS DIFFERENT: health and beauty is the most-enforced claims territory in US consumer marketing because the gap between a legal cosmetic claim and an illegal drug claim is a single word — and platforms enforce the line more aggressively than the law requires, because their liability is collective. The practical rule every live seller must internalize: in this category, the platform's policy is your real statute, the FTC is your backstop, and your supplier's marketing deck is evidence against you, not for you.
THE LEGAL FRAME (SIMPLE VERSION): cosmetics may claim to change appearance ('reduces the appearance of fine lines', 'makes lashes look fuller'); they may not claim to change structure or function of the body ('removes wrinkles', 'repairs hair follicles', 'boosts collagen production') without drug-level authorization that virtually no live-sold product has. Structure/function language triggers FDA territory, and FDA-triggered language on a livestream is an account-ending event on every major platform. Supplements add a layer: 'supports', 'helps maintain' framing is the ceiling; disease treatment or prevention claims ('fights inflammation', 'lowers blood sugar') are the floor of the illegal zone.
